PLATINUM ATHLETIC CLUB MEMBERSHIP TERMS AND CONDITIONS
Members acknowledge and agree to the following terms and conditions:
1. MONTHLY DUES
Membership dues are collected on the 1st of each month for the upcoming billing period. A $20 service fee will be applied to any rejected automatic debit transactions or missed payments. Accounts that remain due for more than 90 days will result in immediate termination of membership. To reinstate a terminated membership, all outstanding balances must be paid in full, along with a prorated amount for the current month if applicable, and a 35% service charge.
2. MEMBERSHIP CARDS
Membership tokens remain the property of the club and must be scanned upon each visit for access. If a token is lost or stolen, a replacement may be issued for a $10 fee.
3. MEMBER’S HEALTH WARRANTY
Members certify that they have no medical conditions that would prevent them from safely participating in physical activities. North West Athletics (dba Platinum Athletic Club) assumes no liability for any injuries sustained while using the facilities. Members acknowledge and accept full responsibility for their use of the club’s amenities at their own risk.
4. HOURS
Management reserves the right to adjust operating hours as needed for reasons such as maintenance, community service activities, or changes in member usage.
5. FACILITIES
The club reserves the right to modify, remove, or change facilities, services, and equipment as necessary.
6. RATE CHANGE
Monthly rates and policies may be subject to change, unless otherwise specified in a fixed-term agreement. Members will be given at least 60 days’ notice prior to any rate changes. Automated payment changes are deemed accepted unless the club is notified in writing by the member.
7. PRE-AUTHORIZED PAYMENTS
Changes to pre-authorized payments must be submitted in writing at least 30 days prior to the member’s billing date.
8. HOUSE RULES
Members are expected to always adhere to proper gym etiquette to ensure a respectful and safe environment for everyone.
After using any machine, bench, or mat, equipment must be wiped down with the provided disinfectant spray.
Athletic clothing and closed-toe shoes are required; jeans, sandals, and work boots are not permitted.
Always re-rack dumbbells, plates, and bars after use, and avoid leaving weights on the floor.
Use equipment as intended, and refrain from dropping or slamming weights unnecessarily.
Respect others’ personal space while exercising, and maintain a courteous atmosphere—profanity, harassment, or aggressive behavior will not be tolerated.
Photography or filming of other members is prohibited unless prior consent is given.
Lockers are for daily use only and must be cleared out after each workout. The club is not responsible for any lost, stolen, or damaged personal items. Members are encouraged not to bring valuables to the club, and personal grooming is prohibited in the locker rooms.
Failure to comply with these rules may result in warnings, suspension, or termination of membership without a refund.
9. DURRATION OF AGREEMENT
This contract is valid for the duration specified in the agreement and will automatically renew on an ongoing basis until the member provides written notice of termination, in accordance with North West Athletics (dba Platinum Athletic Club) cancellation and account change policy.
10. ACCOUNT CHANGES
All account change requests must be submitted in writing at the club and take effect 30 days after acceptance.
11. REFUND POLICY
Members may cancel their contract within 10 days of signing for a full refund of all monies paid. If canceled within this period, the contract is terminated with no further financial or contractual obligations. After 10 days, no refunds will be issued. All prepaid membership are non-refundable, except as required by law.
12. CANCELLATION POLICY
Members may cancel their membership after 10 days under the Buyer’s Right to Cancel, subject to the following:
Any unpaid balances or service charges must be paid in full before cancellation is processed.
Contract memberships cancelled before the end of the agreed term are subject to a $150 cancellation fee.
Prepaid memberships are not subject to buyout fees.
All cancellations must be submitted in writing at the club and take effect 30 days after acceptance by management.
The acceptance of cancellation requests is at the sole discretion of North West Athletics, and submission does not guarantee approval.
13. ENTIRE AGREEMENT
This agreement constitutes the complete and final agreement between the member and the club. Any modifications to this agreement must be made in writing. Employees are not authorized to make independent agreements outside of the club’s established policies.
By signing this agreement, members acknowledge and agree to adhere to the Terms and Conditions outlined herein. The club reserves the right to modify or update these terms as necessary.
